The rules of the game.

These terms govern your use of Netounim. By creating an account you agree to them. Most of this is what you’d expect — you don’t use the platform to send spam, we don’t lose your data — but please read it through so there are no surprises later.

In plain English

You sign up, pay for credits, send compliant outbound. We provide the platform and the data behind it. You own your content. We own the software. Either side can leave with 30 days’ notice. If something goes wrong, our liability is capped at what you paid us in the last 12 months. Disputes go to French courts under French law.

Acceptance

By creating an account, using the API, or installing the browser extension, you accept these terms on behalf of yourself and, if you’re acting for a company, that company. If you don’t accept them, don’t use the service.

Eligibility

You must be at least 16 years old and have the legal authority to enter into a contract. If you’re signing up on behalf of a company, you confirm you have authority to bind that company to these terms. Netounim is a B2B product — personal-consumer use is permitted but unsupported.

Your account

You’re responsible for keeping your credentials safe. We recommend enabling 2FA from the day you sign up. If you suspect your account has been accessed without your permission, email [email protected] within 24 hours so we can rotate your sessions and investigate.

You’re responsible for everything that happens through your account — invited team members, API keys you generate, integrations you authorise.

Subscription, credits and billing

Plans renew automatically every month or year depending on what you chose at signup. We charge the payment method on file at the start of each billing period.

Credits included with your subscription reset at the start of every billing cycle and don’t roll over. Pay-as-you-go top-ups you buy separately never expire.

You can downgrade, cancel or pause at any time from Settings → Billing. Cancellation takes effect at the end of the current cycle; we don’t pro-rate refunds for partial months. Within the first 14 days of a paid plan, if you’ve used less than 20% of the monthly credit allowance, we’ll refund the subscription fee — just ask.

Prices are in EUR. VAT is added where applicable. Tax invoices live in Settings → Billing and are kept for 10 years per French law.

Acceptable use

You agree NOT to use Netounim to send unsolicited bulk email (spam), market to consumers without an opt-in, send malware or phishing, harvest data on individuals you have no legitimate B2B interest in contacting, scrape platforms that prohibit it, or impersonate other people.

We enforce this. Workspaces caught sending spam — measured via bounce rate, complaint rate or block-list reports — get a warning, then a suspension, then a permanent ban. We don’t refund credits used to send messages we later determine were abusive.

Your content stays yours

The leads you upload, the templates you write, the workflows you build — all of it remains your property. We store it, process it on your instructions, and hand it back whenever you ask.

You grant us a narrow licence to host, transmit and display your content as needed to run the service. That licence ends the moment you delete the content or close your account.

Third-party data providers

Some features (Phone Waterfall, Email Verifier) rely on third-party data sources. We disclose every provider in our sub-processors list at /security#subprocessors. The data they return is supplied as-is; we make no guarantee that any specific email or phone number is accurate or current.

It’s your responsibility to use returned data in line with the law that applies to you — including GDPR’s legitimate-interest test for B2B outreach, CAN-SPAM in the US, CASL in Canada, and equivalent rules in other jurisdictions.

Our intellectual property

The Netounim software, brand, design, and documentation are ours. You get a non-exclusive, non-transferable, revocable licence to use them via the service while your subscription is active. You may not copy the codebase, reverse-engineer the platform, or build a competing product using our materials.

Termination

You can cancel at any time from Settings → Billing.

We can suspend or terminate your account if you breach these terms, fail to pay, or use the service in a way that puts other users or our infrastructure at risk. Where the breach is fixable, we’ll give you 14 days’ notice and a chance to put things right before we cut access.

On termination, your data follows the retention schedule in our privacy policy. You can export everything until the moment the account is deleted.

Warranties and disclaimers

We work hard to keep Netounim running. We don’t promise it will be available 100% of the time, that every email lookup will succeed, or that every phone number returned will reach a human.

The service is provided "as is". To the maximum extent allowed by law, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. Specific SLAs (uptime, accuracy commitments) only apply where they’re written into an Order Form you’ve signed with us.

Limitation of liability

To the maximum extent permitted by law, our total liability to you for any claim arising out of these terms or your use of the service is capped at the amount you paid us in the 12 months immediately before the event giving rise to the claim. We are never liable for indirect, consequential, or lost-profit damages.

Nothing in these terms limits liability for gross negligence, wilful misconduct, fraud, or anything the law says can’t be limited.

Indemnification

You agree to defend and indemnify us against third-party claims arising out of: (a) content you upload or send through the service, (b) your use of the platform in violation of these terms or the law, and (c) any breach of the acceptable-use provisions above. We’ll let you control the defence of any such claim, but we can participate at our own expense.

Governing law and disputes

These terms are governed by French law. Any dispute that can’t be resolved through good-faith discussion goes to the competent courts of Paris, France.

Nothing here affects mandatory consumer-protection rights you may have where you live — if you’re a consumer in the EU, those rights still apply.

Changes to these terms

We update these terms occasionally. Material changes — anything that affects pricing, your rights, our liability or the scope of the service — are notified to workspace admins by email at least 30 days before they take effect. You can cancel during that window if you don’t agree.

Non-material changes (typo fixes, clearer wording) take effect on publication; the "last updated" date at the top is bumped accordingly.
